Gyanvapi: Muslim side moves SC, urges apex court not to allow ASI to carry out survey
Earlier in the day, the Allahabad High Court rejected the Muslim side plea and instructed the Archaeological Survey of India to continue survey.
Gyanvapi case
The Anjuman Intezamia Masjid Committee has filed a petition with the Supreme Court. The Masjid Committee's lawyer has requested the Supreme Court not to allow ASI to conduct the survey. The Supreme Court stated that it will investigate the matter.
Advocate Nizam Pasha raised the issue before Chief Justice D Y Chandrachud, who was leading a five-judge constitution bench hearing arguments in the Article 370 case and was about to rise for the day, requesting an urgent hearing.
"Today, the Allahabad High Court issued an order." We have filed an SLP in response to the order. I sent an email (requesting an urgent hearing). "Let them not go ahead with the survey," Pasha remarked. "I will look at the email right away," replied the CJI.
Earlier in the day, the Allahabad High Court dismissed the Muslim side's petition and directed the Archaeological Survey of India to continue its survey.
On July 27, the High Court deferred its decision on a petition challenging a Varanasi district court judgment directing the ASI to conduct a study to ascertain whether the Gyanvapi mosque was built on top of a temple. The survey is set to begin on August 4th, according to the ASI.
In its ruling, the HC stated, "Issue of commission is permissible." The Varanasi Court was correct. In the interest of justice, a scientific survey is required."
